Terms of service

Terms of Service

Last updated: 5 October 2026

Welcome to Yours Truly.

These Terms of Service govern your use of our website and your purchase of products from Yours Truly.

Throughout these Terms, the words “Yours Truly,” “we,” “us,” and “our” refer to Yours Truly.

By accessing our website, browsing our store, creating an account, placing an order, or otherwise using our services, you agree to these Terms.

If you do not agree with these Terms, please do not use the website or place an order.

Nothing in these Terms limits any rights you may have under applicable South African law, including the Consumer Protection Act and Electronic Communications and Transactions Act.

1. Our Online Store

Yours Truly operates an online clothing store offering apparel and related products.

Our online store is powered by Shopify.

We may update, change, discontinue or introduce products and features from time to time.

2. Eligibility to Purchase

By placing an order, you confirm that you have the legal capacity to enter into a binding agreement or that you have the necessary consent or assistance of a parent or legal guardian where required.

You must provide accurate and complete information when placing an order.

3. Product Information

We try to display our products as accurately as reasonably possible.

This includes information relating to:

  • colours

  • sizing

  • fit

  • fabrics

  • materials

  • product features

  • images

  • availability

However, colours and appearance may vary slightly depending on your screen, lighting and device.

Minor variations that are normal for textiles or manufacturing do not necessarily mean that a product is defective.

Where an item is materially different from what was described or does not meet applicable legal quality standards, your statutory rights remain unaffected.

4. Sizing

Customers are responsible for selecting the appropriate size when placing an order.

Our Everyday Tee is designed to fit true to size, and we recommend reviewing our Size Guide before purchasing if you are unsure.

If you order the wrong size, you may request an exchange or return in accordance with our Returns & Refunds Policy.

5. Product Availability

All products are subject to availability.

Adding an item to your cart does not reserve that item.

In rare circumstances, an item may become unavailable after you place an order.

If we cannot supply an item you purchased, we will contact you and provide an appropriate refund or alternative option where agreed with you.

6. Orders

When you place an order, you are making an offer to purchase the products in your order.

Orders may be subject to:

  • successful payment

  • stock availability

  • fraud and security checks

  • verification of order information

We may decline or cancel an order where there is a legitimate reason to do so, including suspected fraud, incorrect payment information, obvious pricing errors, stock unavailability or an inability to fulfil the order.

If we cancel an order after payment has been received, we will refund the amount due to you.

We will not cancel an order arbitrarily or in a manner that unfairly limits your rights under applicable law.

7. Prices

Unless otherwise stated, prices displayed on our South African store are shown in South African Rand (ZAR).

The final amount payable will be shown during checkout before you complete your purchase.

Delivery charges and any other applicable charges will be shown where relevant before your order is completed.

We may change product prices from time to time.

A price change will not normally affect an order that has already been accepted and paid for, except where permitted by law or where there is an obvious and genuine pricing error.

8. Pricing Errors

We try to ensure that all prices are accurate.

However, genuine technical or human errors may occasionally occur.

If a product has been displayed at an obviously incorrect price, we may contact you before fulfilling the order.

Where appropriate, you may choose to:

  • proceed at the correct price, or

  • cancel the affected item or order and receive a refund

Nothing in this section allows us to disregard pricing obligations imposed by applicable consumer law.

9. Payment

Payment must be made using one of the payment methods offered at checkout.

Payment processing may be handled by Shopify and/or third-party payment providers.

We do not normally store your complete payment-card information ourselves.

An order may not be fulfilled until payment has been successfully authorised or otherwise confirmed.

10. Promotions and Discount Codes

From time to time we may offer:

  • promotions

  • bundles

  • discount codes

  • special offers

  • sale pricing

Promotions may have specific terms, eligibility requirements or expiry dates.

Unless expressly stated otherwise:

  • promotions cannot be combined

  • discounts cannot be applied retrospectively

  • promotional offers are subject to availability

We reserve the right to correct or withdraw a promotion where there has been an obvious error, abuse or misuse, subject to applicable law.

11. Delivery

We currently deliver within South Africa using The Courier Guy and/or other suitable delivery services where necessary.

Our typical delivery timeframe is approximately 3–5 days, although actual delivery times may occasionally vary due to circumstances outside our reasonable control.

Tracking information will normally be provided when available.

Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Please ensure that your delivery information is correct before completing your order.

For more information, please refer to our Shipping Policy.

12. Incorrect Delivery Information

You are responsible for providing accurate delivery details.

If an order is delayed, returned or misdelivered because incorrect or incomplete information was supplied by the customer, additional delivery costs may apply where legally permitted and reasonably incurred.

Please contact us as soon as possible if you notice an error in your delivery details.

We cannot guarantee that delivery information can be changed once an order has already been dispatched.

13. Returns, Exchanges and Refunds

Returns, exchanges and refunds are handled in accordance with our Returns & Refunds Policy and applicable South African law.

Our voluntary policy currently provides qualifying customers with a 14-day return or exchange period from delivery, subject to the conditions set out in that policy.

Separate statutory rights may apply to:

  • defective goods

  • incorrectly supplied goods

  • damaged goods

  • qualifying online cooling-off periods

Our voluntary policy does not replace or reduce those legal rights.

14. Defective Goods

We want our products to meet the quality customers reasonably expect from Yours Truly.

Where a product is defective or does not meet the quality standards required by applicable South African law, you may have statutory rights to a repair, replacement or refund.

These rights exist independently of our voluntary returns policy.

Nothing in these Terms is intended to exclude or limit any statutory warranty or remedy that cannot lawfully be excluded.

15. Garment Care

Proper care helps maintain the appearance, fit and lifespan of your clothing.

Our recommended care instructions are:

  • Machine wash cold with like colours

  • Do not bleach

  • Do not tumble dry

  • Do not dry clean

  • Do not iron over prints

  • Line dry in the shade

Normal wear and tear or damage caused by misuse, accidents or failure to follow reasonable garment-care instructions will not necessarily constitute a product defect.

Natural fabrics may also experience normal changes over time through washing and wear.

16. Website Use

You may use our website for lawful personal shopping and browsing purposes.

You must not:

  • use the website for unlawful purposes

  • attempt to gain unauthorised access to our systems

  • interfere with the website's security or operation

  • introduce malicious software or harmful code

  • scrape or copy website content for unauthorised commercial use

  • impersonate another person

  • submit false or fraudulent orders

  • misuse promotions, discount codes or payment systems

  • use automated systems in a way that disrupts the website

We may restrict access where reasonably necessary to protect our business, customers, systems or legal rights.

17. Intellectual Property

Unless otherwise stated, the content of the Yours Truly website belongs to Yours Truly or is used with appropriate permission.

This may include:

  • branding

  • logos

  • photographs

  • graphics

  • product designs

  • website copy

  • layouts

  • videos

  • artwork

  • other creative material

You may browse the website and use its content for normal personal shopping purposes.

You may not reproduce, distribute, modify, sell, commercially exploit or otherwise use our intellectual property without permission where such permission is legally required.

18. Third-Party Services

Our store may rely on third-party providers such as:

  • Shopify

  • payment processors

  • The Courier Guy

  • analytics providers

  • marketing platforms

  • customer-service providers

These providers may operate their own services under their own terms and privacy policies.

We are not responsible for the independent acts or omissions of third parties where those matters are outside our reasonable control, subject always to any responsibility that applicable law places on us.

19. Third-Party Links

Our website may contain links to third-party websites or services.

These links are provided for convenience.

We do not control third-party websites and are not responsible for their content, security, availability or privacy practices.

You should review the relevant terms and privacy policies when visiting third-party websites.

20. Privacy

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

Our Privacy Policy explains:

  • what information we collect

  • why we collect it

  • how it may be shared

  • how long it may be retained

  • your privacy rights

If you have a privacy-related request, contact:

yourstrulyclo1@gmail.com

21. Website Availability

We try to keep our website available and working properly.

However, we do not guarantee uninterrupted access at all times.

The website may occasionally be unavailable because of:

  • maintenance

  • technical problems

  • hosting issues

  • Shopify outages

  • internet disruptions

  • security incidents

  • circumstances outside our reasonable control

We may temporarily suspend parts of the website where reasonably necessary.

22. Errors and Updates

Information on the website may occasionally contain:

  • typographical errors

  • incorrect descriptions

  • pricing errors

  • outdated information

  • availability errors

We may correct genuine errors and update information where reasonably necessary.

Any correction affecting an existing customer order will be handled fairly and in accordance with applicable law.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Yours Truly will not be responsible for indirect or consequential losses that were not reasonably foreseeable and that arise solely from circumstances outside our reasonable control.

However, nothing in these Terms:

  • excludes liability that cannot legally be excluded

  • excludes liability for gross negligence where such exclusion is prohibited

  • removes rights granted to consumers under applicable law

  • limits remedies available for defective or unsafe goods where those remedies apply

Your statutory consumer rights remain unaffected.

24. Events Outside Our Reasonable Control

Sometimes we may be unable to fulfil an obligation because of circumstances outside our reasonable control.

Examples may include:

  • severe weather

  • transport disruption

  • courier disruption

  • power or communications failures

  • strikes

  • natural disasters

  • government action

  • widespread technical failures

Where this happens, we will take reasonable steps to minimise the impact and fulfil affected orders as soon as reasonably possible.

This section does not remove any rights you may have under applicable law.

25. Changes to These Terms

We may update these Terms from time to time to reflect:

  • changes to our store

  • changes to our products or services

  • changes to technology or service providers

  • legal or regulatory requirements

  • changes to our business practices

Updated Terms will be published on our website.

Changes will normally apply from the date they are published and will not unfairly change rights relating to transactions already completed.

26. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

27. No Waiver

If we do not immediately enforce a right under these Terms, that does not mean we permanently waive that right.

28. Governing Law

These Terms and your use of our South African online store are governed by the laws of the Republic of South Africa.

Nothing in this section prevents a consumer from exercising any right to approach a regulator, ombud, tribunal or court that is available under applicable South African law.
